What is the charge against Wankhede?
NCP leader Nawab Malik has accused NCB official Sameer Wankhede of being a Muslim by birth. He forged his documents and became a Dalit or a Scheduled Caste person and got a job in IRS. To prove his allegations, Nawab Malik also revealed photographs of Sameer Wankhede’s marriage as well as sharing Sameer Wankhede’s nickname and birth certificate. Malik alleged that Sameer Wankhede’s father was a Muslim.
Sameer Muslim So what is the problem?
India is a secular country. The Constitution of India gives religious freedom to the people living in India and guarantees religious freedom as a fundamental right. By law, Scheduled Castes have 15 per cent reservation in government jobs. This provision dates back to the 1950s. It was revised twice. The first was in 1956 and the second in 1990. Accordingly, the Supreme Court ruled that no person except a person who believes in Hinduism, Sikhism or Buddhism is considered a person belonging to a Scheduled Caste, but Muslims are not Dalits.
Do Muslims also get reservations?
The Constitution of India does not provide for reservations on religious grounds. The Constitution is talking about caste reservations. However, in some states and even at the center, reservations are given in jobs to the Muslim community in some lists, although they get these reservations as a backward or very backward class rather than a Muslim. It is clear that no Muslim in the quota of Dalits or Scheduled Castes can claim reservation. Nawab Malik alleged that Sameer Wankhede had done the same.
What happens in the case of inter-caste marriage and conversion?
The Supreme Court issued orders on the subject in 1950. It clearly states that in order to avail the benefit of reservation, he has to submit a certificate that he is a Scheduled Caste by birth and the status cannot be changed. Children born through this marriage are considered to belong to the paternal caste. If the mother belongs to a Scheduled Caste, the children must prove that they grew up as an SC member.
If the allegation against Sameer Wankhede is proved.
If Nawab Malik’s allegations against NCB official Sameer Wankhede are found to be true, Sameer Wankhede will have to resign. Not only this, a criminal case will also be registered against them, as well as salary recovery can be done.
